Deliverable 1: Inception Report and Detailed Workplan

• Develop a detailed workplan, methodology, and implementation approach for undertaking the assignment, in consultation with the Project Team and subject to endorsement by the Director of Climate Change, ensuring alignment with agreed objectives, deliverables, and timelines.

Deliverable 2: Legal, Policy and Institutional Review

The Consultant shall undertake a comprehensive review of the legislative and policy framework governing planned relocation in Fiji by reviewing the:

• Review of Part 12 of the Climate Change Act and other relevant national legislation, policies, strategies, frameworks and sectoral instruments relating to planned relocation;
• Review of relevant regional and international legal frameworks, standards and good practices relating to planned relocation and climate-induced displacement, with a view to identifying relevant lessons and approaches for Fiji;

Deliverable 3: Review the Existing Implementation Framework

• Planned Relocation Standard Operating Procedures (SOPs), Planned Relocation Guidelines, and associated manuals, templates, tools and operational procedures;
• Mapping of the institutional arrangements, governance structures, and roles and responsibilities of relevant government agencies and other stakeholders involved in planned relocation;
• Assessment of the current implementation of Part 12 of the Climate Change Act, including the identification of key strengths, lessons learned, implementation gaps and challenges.
• Stakeholder Consultation is integrated as cross cutting throughout activity across all tasks for this assignment. The Consultant shall undertake consultations. 

Deliverable 4: Regulatory Readiness Assessment

• Prepare an inventory of relevant planned relocation implementation instruments and regulatory components, supported by an assessment matrix that categorizes each component as: (i) suitable for regulation; (ii) requiring further refinement; or (iii) more appropriately addressed through non-regulatory instruments, including guidelines, policies, operational manuals, or other supporting documents.

• Assess each component against the following criteria: (i) legal clarity, certainty, and enforceability; (ii) consistency with the Climate Change Act and other relevant legislation; (iii) clarity of institutional mandates and responsibilities; (iv) operational maturity and evidence of implementation; and (v) adequacy of supporting systems, procedures, institutional capacity, and resources.

Deliverable 5: Regulatory and Implementation Gap Analysis & Roadmap

• Based on the findings of the review, the Consultant shall identify gaps that may constrain the development or implementation of Planned Relocation Regulations. The Consultant shall recommend measures required to address these gaps prior to, or alongside, the development of regulations.
• The Consultant shall prepare a Regulatory Readiness and Roadmap outlining a practical pathway for the development and implementation of Planned Relocation Regulations.
• Consultant shall under stakeholder validation exercise for consultation and vetting of review findings with relevant government agencies, statutory bodies, development partners, and other stakeholders identified by DoCC.

Deliverable 6: Drafting Instructions

• Where regulatory provisions are assessed as being sufficiently mature, the Consultant shall prepare high-level drafting instructions to guide the Department of Climate Change and GGGI embedded team to support the possibility of creating regulations for Part 12.

Deliverable 7: Consolidated Final Report

• The consultant shall prepare a final consolidated report bringing together the outputs of deliverables 1 to 6, incorporating comments received from the department of climate change and GGGI and shall finalize all deliverables in their accepted form. Deliverables and payment schedule.

The Consultant shall deliver the outputs set out below in accordance with the agreed timeline and payment schedule. Payments shall be made upon the satisfactory completion and acceptance of the relevant deliverable by the Department of Climate Change and GGGI.

Where a payment covers more than one deliverable, all deliverables in that group must be accepted before payment is released. Timelines are cumulative from contract signature.

*Timelines refer to the Consultant's working period for each milestone and run cumulatively from contract signature. Periods during which a submitted deliverable is under review by the Department of Climate Change or GGGI are additional to the timelines shown; the contract duration of six months allows for this review turnaround.

The consultant should have:

• Masters in Law, Environmental Law, Public Policy, or related field;
• Minimum 5 years’ experience in legal drafting, legislative review, or regulatory development;
• Demonstrated experience in climate change law, environmental governance, or disaster/displacement policy;
• Experience in developing regulations or subordinate legislation;
• Familiarity with Pacific legal and governance contexts is highly desirable;
• Strong analytical, writing, and stakeholder engagement skills.
• A proactive attitude, with an ability to find workable solutions promptly.
• Punctual, professional, and ability to work under pressure and meet deadlines.
• Strong interpersonal skills and the ability to work with multicultural and interdisciplinary staff

• No conflict of interest arises while taking this assignment.
